Estate Administration -If someone dies without leaving a Will their estate will be dealt with according to the rules of Intestacy. This means that their assets will be distributed amongst their relatives according to a set legal formula.

If the deceased had assets in their sole name worth more than £5,000 then those assets cannot be released until Letters of Estate Administration have been obtained. This will usually be dealt with by the next of kin.

Thereafter, the process of administering the estate is very similar to the process for obtaining Probate. The administrators will need to identify and value all the assets, pay any outstanding debts, then distribute the balance of the estate to the surviving relatives or their issue (children) in accordance with the intestacy rules.
