Obtaining probate is not as hard as people think, We are the UK’s leading Probate brokers and have a vast selection of solicitors so we can get your the best probate quote possible.
One reader from Brighton contacted financial advice site This is Money, asking advice about what to do when someone dies.
The reader known as B.W. was unable to obtain a copy of their Grandfather’s will despite being told that they were named in the legal document. Despite regularly contacting those carrying out executor duties, requests to see the will were denied.
Simon Moon, an adviser for This is Money informs that if probate has been granted, the reader can visit the principal probate registry for England and Wales – based in London – to make an in person request for the will. In addition, Moon advises that the reader could visit their district probate registry or look on HM Courts Service website to find an address of one of England and Wales’ 18 sub-registries.
The reader is advised that they can also obtain a copy of the will by writing to The Postal Searches and Copies Department in the York Probate Sub-Registry, providing their full name and address, the date that their Grandfather died and enclosing the required fee of £5.
If probate has not been granted, the reader is directed to perform a standing search. Again there is a small fee of £5 to the HMCS for the search, nevertheless, the reader should receive a copy of the will through this process.
By obtaining a probate solicitor to take care of the deceased’s affairs, contentious probate situations can be negated, co-ordinating the needs of all parties effectively.
